Audit firm to Gupta metals empire fined and banned for ‘egregious’ failures

The United Kingdom's Financial Reporting Council has imposed substantial penalties on a small audit firm for what it described as egregious failures in its work for Sanjeev Gupta's industrial conglomerate.

King and King, together with its managing partner Milankumar Patel, received fines totalling approximately three hundred and seventy-eight thousand pounds following a four-year regulatory investigation.

The watchdog issued a severe reprimand and placed significant restrictions on the firm's capacity to undertake future audit engagements.

At the heart of the case lay the firm's failure to identify clear self-interest threats arising from its extensive financial dependence on GFG Alliance companies.

Between 2018 and 2020, King and King conducted more than one hundred and forty audits for entities within Gupta's metals empire, including Liberty Specialty Steels and Alvance British Aluminium.

Revenues from GFG Alliance clients constituted nearly forty-one percent of the firm's total income by 2021, far exceeding the regulatory threshold of fifteen percent.

The Financial Reporting Council emphasised that this excessive reliance on a single client had prompted Patel and his firm to adopt a fundamentally flawed approach to ethical compliance.

Not only did they breach independence standards across all audits, but they also neglected essential procedures such as risk assessment, income recognition, and going-concern evaluations.

The regulator characterised the deficiencies as widespread and pervasive, suggesting that the integrity of the audited financial statements had been severely compromised.

The case raises broader questions about whether small audit firms possess the institutional capacity to scrutinise complex multinational operations without compromising their objectivity.

Had King and King adhered to the established fifteen-percent revenue cap, the self-interest conflict might never have materialised on such a scale.

Industry analysts have cautioned that regulatory bodies should intensify oversight of firms whose client portfolios exhibit dangerous levels of concentration.

The Financial Reporting Council has since updated its guidelines to reinforce the prohibition against excessive dependence on any single audit client.
