Justice Centre Report Calls for Eight-Step Legislative Roadmap to Restore Canadians' Privacy

The Justice Centre for Constitutional Freedoms has published a sweeping new report that outlines an eight-step legislative roadmap aimed at dismantling what it characterizes as Canada's expanding surveillance state.

Authored by Nigel Hannaford, a veteran journalist and public policy analyst, the document urges federal lawmakers to reverse recent legislation that has broadened government monitoring powers while simultaneously eroding established privacy protections.

Central to the report's argument is the assertion that privacy constitutes far more than a personal preference; rather, it functions as a constitutional safeguard underpinning fundamental rights.

The authors emphasized that freedom of thought, freedom of expression, personal autonomy, and human dignity all depend on robust privacy protections.

Were citizens to believe that their communications, financial transactions, or online activities were being monitored, they would inevitably self-censor and modify their behaviour.

Among the proposed reforms, the report calls for amendments to Bill C-8, which governs cyber security, arguing that the legislation should prohibit the government's broad access to subscriber information.

It further recommends reinstating stronger legal thresholds and judicial oversight for searches and seizures.

Additionally, the report advocates amending the Proceeds of Crime and Terrorist Financing Act so that judicial authorization would be required before personal financial data is disclosed to law enforcement agencies.

The report also insists that information which does not lead to an intelligence disclosure should be deleted, and that mandatory reporting obligations should apply only to transactions for which there exist reasonable grounds for suspicion.

Not only does this legislative roadmap seek to curtail governmental overreach, but it also attempts to recalibrate the balance between national security imperatives and individual constitutional rights.
